John Doe has ADHD. John was expelled from St. Joseph University. John claims he was falsely accused of sexual misconduct, and he is suing St. Joseph’s University for denying him his disability right to accommodations for his ADHD. Some interesting facts about this John Doe/Jane Roe case: When John and Jane first met at a party, Jane flirted with John, and said she wasn’t a SJU student. That is a lie. Jane is a student. Jane told John she is a recovered cocaine and heroin addict. Jane was drinking that night and attempted to buy cocaine. John was ‘concerned for her well-being’ and ‘discouraged Roe from buying cocaine’. Throughout their time together at the party Roe ‘continued to demonstrate a romantic interest in Doe, by flirting with him, kissing him and giving him her cell phone number.’ A week later Roe accused Doe of sexual misconduct. John Doe was ‘shocked, horrified and humiliated because nothing untoward at all had happened with Roe.’ Doe received accommodation for his ADHD at SJU, which ‘SJU is well aware of’ but ‘throughout the course of Doe’s investigation, St. Joseph University ‘not only failed to make provisions or accommodations for Doe’s ADHD and slower processing speed, they failed to advise him that accommodations would be necessary and what if any, accommodations might be available to him.’  Read John Doe’s complaint against St Jopeph University here, courtesy of Dan Bauman.

SJU is not the only university to deny ADHD students their disability rights during a TitleIX sexual misconduct hearing. Drake University is facing two lawsuits for denying disability rights to a falsely accused male.
