VICTIM CENTERED: Death of Due Process
Due process is a bedrock concept in our nation’s legal system. The words “due process” appear twice in the Constitution — in the Fifth and the Fourteenth Amendments. Both Amendments guarantee due process when someone is denied “life, liberty, or property.
Innocent males are being falsely accused at record numbers. At the heart of the problem is a biased system that is based more on ideology than science or common sense. This system has weakened due process, and removed the presumption of innocence. The organization SAVE– Stop Abusive and Violent Environments- works for policy reform to protect victims, support due process and stop false allegations. This month in their effort to fight for the presumption of innocence, SAVE is exposing one of the biggest problems on college campuses when it comes to an accusation of sexual misconduct. And this is the college’s reliance on a specific type of investigative method, called “trauma-informed.” A trauma informed investigation presumes the guilt of the accused and “cherry-picks” the evidence in order to support a determination of responsibility.
Victim centered investigations are indeed leading to the death of due process for all Americans.
