MALE Accused of Sex Assault Sues St. Olaf. Claims “Pre-Determined Result.”
A student expelled from St. Olaf after being accused of sexually assaulting another student in November of last year has filed a lawsuit against the school, alleging the suspension was “the result of a rigged and unfair disciplinary process put in place to rush to a pre-determined result.” His lawsuit, filed in federal court in Minnesota last week, seeks to have the results of the disciplinary process ruled in violation of Title IX, and to require the school to expunge the disciplinary proceedings from its record. It also asks the court to declare the school’s conduct “to be wrongful, willful, intentional, and reckless,” as well as to prohibit the school from referencing the proceeding in the event of third-party inquiry. It also seeks to require the school to answer in the negative if any third party inquires if the student has been accused of sexual misconduct, or any similar question. And it seeks damages of not less than $75,000 for “mental anguish, loss of trust, severe emotional distress, serious mental injury, injury to reputation, past and future economic loss, deprivations of due process, loss of educational opportunities, loss of future career prospects, and other injuries proximately caused by the wrongful conduct of defendants.”
