Grant Neal, a student-athlete at CSUP, claims in his lawsuit that he is the victim of an almost preposterous railroading by the collegiate sex police. Many men have claimed they were wrongfully convicted thanks to a “he said, she said” situation where a girl’s accusation without any further evidence was enough to get them kicked out. But in Neal’s case, his alleged victim actually consistently denied ever being raped.

In the summer of 2013, Palo was found not guilty by an administrative law judge…The ISU Judicial Affairs Committee appealed the decision to ISU President Steven Leath. “Mr. Palo suffered at the whim of the arbitrary administrative decisions made by President Leath, other administrators at ISU and the Board,” wrote Palo’s attorneys. The lawsuit lists the following grievances against Iowa State and the Iowa Board of Regents: violating Iowa Code chapter 625.29, tortious interference, breach of contract and pain and suffering.

It’s true that since issuance of the Dear Colleague letter, colleges and universities have frequently presumed guilt. But they generally go through the motions of providing fairness. So it’s jarring to see a federal judge suggest that students accused of sexual assault don’t have a right to be presumed innocent.
