Jason Casares, Indiana University-Bloomington’s Title IX coordinator was accused of sexual assault earlier this month by a colleague. An independent investigation ordered by ASCA found Casares not responsible. Despite the finding, Casares’ reputation has been destroyed. How could anyone making a sexual assault accusation want to confide in someone who had himself been accused of sexual assault?

North Carolina Congresswoman Virginia Foxx accused OCR of using its “Dear Colleague” letter process and an “implied threat” of investigations and loss of federal funding as a weapon against schools to require them to handle allegations of campus sexual assault. These threats from OCR have incentivized schools to abandon due process and the truth in order to prove to the department that they take sexual assault seriously.

[Judge]Smith upheld the student’s allegation that he was discriminated against because of his male gender, which led Brown to reach an erroneous outcome in suspending him for two-and-a-half years. The accused student’s lawsuit also argued a breach of contract with Brown over the school’s treatment of him once he was accused..Surviving a motion to dismiss doesn’t seem like the biggest legal win, but it is when it comes to students accused of sexual assault and federal court judges.

The legislative branch is retaliating against executive overreach. Consider the lethal letter Sen. James Lankford (R-Okla.) sent to the Education Department concerning its Office for Civil Rights. OCR is insisting on practices discordant with constitutional values. These practices include denying people accused of sexual assault the right to confront their accusers, and subjecting the accused to convictions based on a mere “preponderance of evidence” rather than “clear and convincing” evidence.

Accused students, naively believing that the truth will set them free, are expelled based on no evidence other than an accusation. They are not allowed meaningful due process or any ability to properly defend themselves. Time and time again, schools have bent over backwards to ignore evidence that the accused was innocent. An accused student needs to figure out why he is being wrongly accused and present his case. Knowing that, there are a couple things to do immediately once an accused student receives notice of the accusation.

Campus feminists are demanding that college administrators write highly technical rules for sex, requiring affirmative agreement to participate in each and every action or movement.
