There is a battle being waged in Congress over a law called the Safe Campus Act, which is intended to restore a measure of due process to campus sexual assault and rape adjudications. It would blunt the efforts of the Department of Education’s Office of Civil Rights to turn its mandate under Title IX into an overarching requirement to eliminate all vestiges of a sexually hostile environment on campus.

It doesn’t seem to matter what a college does when responding to a sexual assault accusation — they are always wrong. Accusers decide how they want to proceed once an accusation is made…now OCR is telling schools to ignore what an accuser wants and to open up an investigation as soon as an accusation is made… So, to the OCR, a university that received word of a sexual assault — even if it wasn’t provided in a formal complaint — must immediately upend the accused student’s life and then begin an investigation. Guilty until proven innocent indeed.
