Below is a list of 35 documented false accusations by college females. This list demonstrates why constitutional due process is essential during Title IX sex hearings.

At Austin Peay State University a female student reported a sex assault by a stranger. Campus police determined that the events as described did not occur, and the female false accuser later told the APSU police that she was not assaulted. Nov. 2016

Clemson University Student, Abbriyanna Rai-Beth Dutill made a false accusation to the police. The police charged Ms. Dutill for filing a false police report. Mar. 2016

At Clemson University campus police say a report of a student being sexually assaulted on campus is untrue. Sept. 2016

At College of Charleston two students had a valentine hook up date. Afterward the female fabricated an assault and accused her date of rape. Paul Robinson was always innocent and was cleared by a jury. Dec. 2017

At Delta College- University Center Michigan student Mary Zolkowski falsely reported to campus police that she was attacked and raped. Zolkowski was charged with one count of falsely reporting a felony. Aug. 2107

George Washington University student Mariam Kashani falsely accused two black men of raping a white girl at knife point. After all hell broke loose on campus, Kashani’s lawyer called the campus police to say her client had completely fabricated the interracial rape. Dec. 1990

At Hofstra University female Danmell Ndonye falsely accused 5 innocent males of rape when her new boyfriend found out she had sex. Later Danmell admitted her sex orgy was consensual.  Sept. 2009

Liberty University says a female student that reported an abduction and sexual assault was not true. Oct. 2017

Lindenwood University student, Joanna Newberry lied, saying that she was attacked in the basement bathroom of Butler Library. Newberry was dismissed from Lindenwood, and charged with a misdemeanor count of making a false report. March 2014

Michigan State University campus police say a false rape report was filed, accusing three black males of assault. Investigators said the report was false, and an attempted sex assault ‘didn’t actually happen.’ Oct. 2017

At Princeton, Mindy Brickman falsely accused a male student of raping her. When Brickman’s claim fell apart, she wrote an apology in the pages of the Princetonian newspaper, noting that she had never once talked to the man she falsely accused. 1991

At Rollins College student Desiree Nall falsely accused two men of raping her in a bathroom.  After the rape hoax was exposed, Nall was charged for making a false statement to police. April 2005

Sacred Heart University former student Nikki Yovino was accused of making up rape allegations against two football players to gain sympathy from a prospective boyfriend. She was charged with second-degree falsely reporting an incident and fabricating physical evidence. Nov. 2017

Swarthmore College  admitted they acted unfairly in charging a male student with sex assault. Nov. 2014

University of Alabama  student, Emma Mannion falsely claimed she was raped by two men. Video surveillance didn’t support her accusation, and eventually Emma acknowledged she lied. Emma Mannion was arrested on a misdemeanor charge of filing a false report.

At University of California, Santa Cruz  Morgan Triplett (a UC Santa Barbara student) found a male on Craigslist to beat her up and have sex with her. She then reported it as rape. Police confirmed that Morgan’s story was a rape hoax. “She was suicidal, and she wanted something to almost bring her back to reality.” April 2013

University of Central Oklahoma’s police say a female student who reported an abduction, and sex assault by two men is false. Sept. 2017

UNC-Chapel Hill’s  opportunist white girl Delaney Robinson falsely accused black athlete Allen Artis of assault. Allen Artis was always innocent, and thankfully he could afford a lawyer.

University of Florida former student Tanya Borachi lied to police about being bound and gagged. Borachi’s family was expecting her to graduate soon, but she wasn’t enrolled. Borachi told police she fabricated the story. Police charged her with filing a false police report. May 2013

University of Oklahoma’s Rodney Anderson was falsely accused by opportunist liar Courtney Thornton. Thornton was accused of lodging a false rape accusation against Mr. Anderson. Dec. 2017

University of Oregon A female student falsely accused basketball player Kavell Bigby-Williams of assault. “No charges have been nor will be filed in the case.”  Aug. 2017

At University of Pennsylvania Jane Doe falsely accused John Doe of assault. Rather than be exposed for its faulty and covert Title IX sex hearing, UPenn settled with John Doe. Nov. 2017

University of Southern California Armaan Premjee is innocent. CA Judge rules that the female falsely accused the male, that she was the aggressor, and that she fabricated her assault. Aug. 2017

A false complaint was filed by a dweeb against USC kicker Matt Boermeester. Matt was expelled while his supportive girlfriend Zoe Katz was harassed for not throwing Matt under the bus. July 2017

University of Texas President Gregory L. Fenves allowed a wealthy female student to lie about being assaulted. In court John Doe prevailed, proving his innocence, while exposing Fenves disgraceful actions. Nov. 2017

University of Wyoming student Meghan Lanker-Simons accused herself of rape on FB. Police investigated the incident and determined that the FB post was a hoax perpetrated by Meghan herself. Meghan Lanker-Simons was charged with interfering with a police investigation. May 2013

Winthrop University police say a female student filed a false sex assault report. “Winthrop Police found no evidence to substantiate the allegation that an assault occurred …the report by a student that she was sexually assaulted is unfounded.” Jan. 2017

I agree with journalist Cathy Young when she wrote “The Duke lacrosse case reminds us that false accusations of sex crimes do happen and that the wrongly accused are the real victims.”

And it is the reason why I fight for due process for college students accused of Title IX sexual misconduct.

STUDENTS ACCUSED of Sex Assault Are Suing Colleges And Winning in Court

Nearly a year after having what he claimed was consensual sex and she claimed was assault, the two Aquinas College students were back together, this time separated by a curtain. For 50 minutes, they appeared in front of a panel of employees of the college in Grand Rapids, Michigan. In a 10-minute opening statement, the male student defended himself against charges he had sexually assaulted the female student. The female student offered no opening statement. A few questions from the panel later, the hearing was done. Six days later, the male student was expelled. Ten months later, he filed a federal lawsuit. Several months after that, Aquinas settled the lawsuit. Those involved are barred from talking about the case by the agreement. In suing, the Aquinas student joined a growing tide of male students, accused of sexually assaulting fellow students, who have lodged federal lawsuits against their schools, alleging discrimination and violations of their due process rights.

In 2011, then-President Barack Obama’s administration urged universities to take more action on sexual assault complaints. Since then, universities have lost more decisions in these lawsuits than they have won, according to an analysis of federal court filings. Most of the losses are judges deciding against universities’ motions to dismiss the cases. The losses share a problem, said KC Johnson, a professor at Brooklyn College and the co-author of “The Campus Rape Frenzy: The Attack on Due Process at America’s Universities.” “One commonality is the lack of cross-examination,” he said. “Courts are saying each side should have the opportunity to question each other.”

One of the people paying attention to the court rulings is U.S. Education Secretary Betsy DeVos, who has proposed new regulations for how colleges handle sexual assault. Among the regulations — live hearings with cross-examinations.

AS VP JOE Biden Rewrote The Rules of Sex Culture on College. Now He Lives in the World of Accusation That He Created

In the past few days, Biden’s not-yet candidacy has been rocked by accusations of unwanted touching. Joe Biden is now living in the world of accusation he helped to create. It is one of peril for the accused, in which they are subjected to expansive definitions of sexual misconduct and little benefit of the doubt. Biden helped to bring it about as the leader of the Obama administration’s cornerstone effort to end sexual assault at colleges and universities, a worthy undertaking that quickly spiraled into overreach..In April 2011, Biden and Education Secretary Arne Duncan announced the release of a bombshell letter, with the bland greeting “Dear Colleague,” to the country’s 4,600 institutions of higher education. It laid out new directives for how campuses were to root out and punish sexual assault. The accused were to be judged under the lowest standards of evidence, the definitions of misconduct were widely broadened, third-party reports could trigger an investigation even if the alleged victim did not think there had been a violation, and more. Title IX is the federal law that prohibits discrimination on the basis of sex in education. Under Obama administration insistence, college offices tasked with administering Title IX became vast and powerful bureaucracies, and students were encouraged to report any perceived violation.

Among the cultural shifts orchestrated by the Obama administration was the assertion that evaluation of campus claims of sexual harassment and assault rest on the subjective feelings of the accuser. That meant it was irrelevant whether the accused had an intention to abuse, harm or offend. The Obama administration expanded the definition of sexual violence to include compliments, or the kind of touching—often unasked for, and sometimes unwelcome—that Biden has engaged in for years. Because of all these edicts, accusations that emerged from consensual encounters, false reports or trivial contact have resulted in investigations and sometimes severe penalties for accused young men. (I wrote about some of these cases in a series in the Atlantic and another article in Slate.)

Biden, a fervent advocate of affirmative consent, has not asked for permission from the people, often strangers, he touches. He has just assumed his touch is welcome. Biden has also failed to acknowledge that male students punished under the system he helped to create have been increasingly fighting back. They have filed more than 400 civil suits, contending that they have been unfairly accused and deprived of their rights. These suits have been getting increasingly favorable—sometimes outraged—rulings from judges. In a recent City Journal article, historian KC Johnson points out that “Biden responded with fury to Secretary of Education Betsy DeVos’ attempts to create fairer procedures for adjudicating campus sexual-assault claims.” Biden also seems to have no recognition that campus encounters can be filled with ambiguity and mixed signals. In an April 2016 speech at the University of Nevada Las Vegas, he mocked the idea that sexual assault allegations might be “complicated,” and told the assembled students that they should “ostracize the abusers” and “make them the pariah on campus.”

If Joe Biden were a college student, the very stroking, smelling and touching he now characterizes as “expressions of affection”—ambiguous as those actions might be—could easily result in his being investigated by the Title IX office, and subjected to education-disrupting punishment.

RULING: Indiana U. Accused Male Denied Injunction

A male student accused of sexual misconduct was denied a preliminary injunction to prevent Indiana University Bloomington from suspending him as a sanction from what he called a “fundamentally unfair disciplinary process.” Filing under the pseudonym of “John Doe,” the student was suspended for four years from Indiana University after an investigation by the school concluded he had engaged in nonconsensual sexual activity.  The case involves an unusual set of facts — while Doe and the female student were having sexual intercourse, someone entered the room and took a picture. The photo was later posted on social media, which led to a separate investigation by the IU Office of Student Conduct. Doe sued IU, asserting, among other claims, Title IX violations and breach of contract. In his motion for preliminary injunction, Doe argued IU’s investigation, disciplinary hearing and decision were biased against him because he is male. Doe argued as part of the investigation, IU did not develop leads or evidence on its own and the investigators arbitrarily determined the relevance of certain witness statements and did not resolve inconsistencies. Also, he asserted IU selectively enforced its policy of not allowing evidence of sexual history when the university did not interview his past sexual partners about his practice of obtaining consent, but did allow evidence that the female student was a virgin at the time of the incident. The case is one of at least 10 filed by students against at least six state universities that claim disciplinary cases concerning allegations of sexual misconduct violated students’ rights.

INNOCENT MALE WINS! Court Finds Flaws With USC. ‘Overlapping & Conflicting’ Role of USC TIX Investigator Kegan Allee.

California’s Second District Court of Appeal found that USC’s Title IX investigator Dr. Kegan Allee, held the “roles of investigator, prosecutor, factfinder, and sentencer” in a case where a student was accused of sexual misconduct. In an opinion published Friday, the three-judge panel ordered a lower court to remove USC’s findings against “John Doe” from his record, and awarded him his costs on appeal. The university will also have to create procedures to allow accused students to cross-examine both their accusers and witnesses in some form. This went even further than the previous appeals panel in the December ruling against USC. “When credibility of witnesses is essential to a finding of sexual misconduct, the stakes at issue in the adjudication are high, the interests are significant, and the accused’s opportunity to confront adverse witnesses in the face of competing narratives is key,” wrote Justice Thomas L. Willhite Jr.  “The notion that a single individual, acting in these overlapping and conflicting capacities, is capable of effectively implementing an accused student’s right of cross–examination by posing prepared questions to witnesses in the course of the investigation ignores the fundamental nature of cross–examination: adversarial questioning at an in–person hearing at which a neutral fact finder can observe and assess the witness’ credibility,” Willhite wrote. “At bottom, assessing what is necessary to conduct meaningful cross–examination depends on a common sense evaluation of the procedure at issue in the context of the decision to be made. From that prospective, a right of ‘cross–examination’ implemented by a single individual acting as investigator, prosecutor, factfinder and sentencer, is incompatible with adversarial questioning designed to uncover the truth.”

Though the accused student is identified pseudonymously in Friday’s ruling, he has been previously identified as former USC football player Bryce Dixon. Dixon was a freshman on a football scholarship when he had sex with Roe, a senior and student athletic trainer. Trainers had been warned not to “hook up” with athletes or they would lose their jobs. But according to Roe’s roommate of three years, Roe had a history of sleeping with football players and had been “reprimanded for unprofessional conduct” before her encounter with Dixon. A key dispute that Allee played down was whether Roe had motive to falsely accuse Dixon. Dixon said she might have accused him so she wouldn’t get fired as a trainer. The judges again scolded Keegan Allee for “inexplicably” failing to check with the athletics department on its policies for trainer-athlete sexual relations, “let alone ascertain the existence of the agreement Roe purportedly signed” promising not to hook up with athletes.

USC’s entire sexual misconduct process is “fundamentally flawed” when serious punishments are on the line, the judges said. The right to cross-examination is hollow in the single-investigator model used by USC and embodied by Allee, who plays “divided and inconsistent roles” in proceedings. Such a person acts as “investigator, prosecutor, factfinder [sic] and sentencer,” a jumble of roles that is “incompatible with adversarial questioning designed to uncover the truth,” according to the opinion: “It is simply an extension of the investigation and prosecution itself.” Allee’s flawed judgments show the danger of the system. Allee was given “unfettered discretion” and used it in “questionable ways,” dismissing Dixon’s theory that Roe had motive to invent rape “almost immediately,” even though Allee had multiple “investigative leads” along those lines. (Allee is now listed as assistant director of the Title IX office. Two officials caught calling an accused student “motherfucker” – Gretchen Dahlinger Means and Patrick Noonan – still have their title.)

The judges noted that other California appeals courts, as well as federal courts, have reached similar conclusions in sexual-misconduct cases that turn on the credibility of witnesses and accusers. Colleges from the private Claremont McKenna to the public University of California-Santa Barbara have been ordered to dump procedures that allow credibility determinations to be made based on written statements, rather than visual assessments of a party’s live answers in response to questions.

A male student has filed a federal lawsuit against Indiana University after the Bloomington school investigated a sexual assault complaint against him and determined that even though he “reasonably should not have known” the woman was incapacitated, he was still responsible for nonconsensual sex.

According to John Doe’s complaint against IU, Jane Doe, made the accusation that John had sexually assaulted and exploited her more than eight months after the two had sex. The pair was photographed without their permission while having intercourse and the pictures were subsequently shared. The complaint states that as soon as John learned about the photo, he immediately took action to have the picture removed. A few days later, the university’s Office of Student Conduct contacted John and indicated he may have experienced sexual misconduct. In a meeting with OSC investigators, John was told they wanted to talk about the picture. However, John alleges the statements he made as part of that investigation were then used against him in the sexual assault investigation…Specifically, while John maintained that he had asked for consent, he did not “elaborate on verbal communication” when he was interviewed as a complainant in the photo investigation. Moreover, that complaint states that although the photo investigators found that John did not consent to having the picture taken or disseminated, the sexual assault panel determined he was responsible for the “exploitation.” According to the complaint, a hearing was held Oct. 19, 2018, with three panelists presiding.

The hearing lasted from 1:30 to 8:55 p.m. with most of the witnesses being contacted by phone. Jane’s sister was permitted to testify even though she told the panel she had hit her head and was on her way to the hospital. John’s witnesses were neither contacted by the panel nor mentioned in the final investigation report, although they could have provided information regarding his habit of seeking verbal consent from sexual partners. However,  Jane’s friends were contacted and permitted to testify. The complaint describes the investigation as “shoddy.” It also asserts the “gross lack of process and unfairness afforded to John” is in contrast to the “robust and complete process and control over the scope and timing of the investigation afford to Jane.”

The complaint claims IU violated Title IX because John was treated unfairly because of his sex and the university breached its contract with John when it failed to follow its own policies and procedures and was negligent in enforcing its own policies and procedures. Doe claims the university was biased against him because of his gender and, along with damages, is seeking restitution for the years of tuition he paid to IU. This is the fourth lawsuit filed against Indiana University by a male student accused of sexual misconduct. Colleges and universities across the state have been hit with similar complaints, largely from male students claiming their constitutional rights were violated.
