In New York federal court, Rolling Stone wrapped up the last remaining piece of litigation emanating from its retracted 2014 article about a rape [of proven liar Jackie Coakley] at a University of Virginia campus fraternity. The settlement is the third for Rolling Stone over the Sabrina Rubin Erdely article, titled “A Rape on Campus,” which prompted a commissioned investigation by the Columbia School of Journalism over its faults. The first settlement came after R.S. lost a trial with Nicole Eramo.(Eramo received a $3 million verdict at trial.) Rolling Stone’s second settlement came to a $1.65 million deal with the fraternity itself. And now comes the third settlement. Per the agreement, “some of the fraternity members become beneficiaries of a settlement whose terms were not provided in court.” The stipulations of the settlement included a confidentiality clause.

An attorney for Phi Psi said Monday they’re seeking a “broader area of inquiry” than what was requested by Eramo, and a judge has again ruled that Jackie must comply with a subpoena to turn over documents relating to the case…Jackie’s claims about a gang rape fell apart once it was discovered that the man she allegedly had a date with on that night didn’t exist. UVA Dean Eramo’s lawsuit has been of extraordinary value in bringing to light the flawed process through which the Rolling Stone article was produced. RS reporter Erdely comes across as closed-minded, having already decided on her thesis. Jackie, meanwhile, comes across as even more ideologically extreme than Erdely, and not terribly bright. The conversation gave a sense of Jackie’s extremist beliefs, her rather unappealing personality and if Erdely had been at all open-minded, her penchant for tall tales.

I agree with journalist Cathy Young when she wrote “The Duke lacrosse case reminds us that false accusations of sex crimes do happen and that the wrongly accused are the real victims.”
And it is the reason why I fight for due process for college students accused of Title IX sexual misconduct.
Rolling Stone has settled with former University of Virginia dean Nicole Eramo over the magazine’s portrayal of her in a since-debunked story about a gang-rape that never happened. Rolling Stone and the author (Sabrina Erdely) still face a lawsuit from the fraternity maligned in the article, whose U.Va. house was vandalized and protested after the article was published. The woman who made the false accusation was recently ordered to comply with that lawsuit.
